The court granted certiorari in Briscoe v Virginia to decide whether Virginia’s notice and demand statute for the admission of laboratory reports violated the confrontation clause under Melendez-Diaz v Massachusetts, 577 U.S. ___ (2009). After hearing oral arguments, the court vacated the judgment of the Supreme Court of Virginia and remanded the case for further proceedings not inconsistent with the opinion in Melendez-Diaz.
